John Elway was the driver of a golf cart when his business partner and former agent fell from the vehicle and suffered life-threatening injuries, according to a TMZ report.

I doubt he gets criminally charged with anything.

Civil is of course a different matter. IF alcohol was involved - let’s assume both were beyond the point of intoxication. You have someone who is presumably facing backwards in the cart on the rear seat and under the influence - riding in a disorienting manner. That person falls out and cracks their skull - they are as culpable as the driver for the loss likely.

Even if he was stone sober and Elway visibly drunk - there’s the assumption of risk defense. You know the person you are riding with is a hazard - you took the risk yourself riding with him.

Finally - these are 2 very successful (read rich) people - neither wants negative images of their families getting out into the media. Doubtful any of this ever sees a court - it will be settled privately. Insurers for these types of people are well aware of the cost of legal proceedings and would rather pay a few million for silence than the cost of a high profile defense counsel and entangle their clients in a media circus for 4 years.

I remember the one bad rollover wreck I had that should have killed me (thankfully ended up only banged up with scratches and a likely concussion) the first thing they did when I got to the ER was draw my blood

That’s what I’m not getting - like I speculated earlier - sitting facing opposite the back row - makes sense - especially if you had a few. It’s very possible to just “fall off”.

It made sense if they were with their respective others and Elway driving that he would be on the back with his wife.

But ESPN story read like he was in right front next to Elway. Makes no sense.
