Since the trial ended. there have been questions about what happens to Amber Heard now after Johnny Depp’s verdict and his win in their defamation case.
Depp and Heard were married from 2015 to 2016. Heard filed for divorce in May 2016 after 15 months of marriage. In her divorce filing, she also obtained a temporary restraining order against Depp, claiming that he abused her while under the influence of drugs and alcohol. Depp denied the accusations, and a $7 million settlement was reached out of court in August 2016. Heard pledged to donate the money to the ACLU and the Children’s Hospital of Los Angeles. “Our relationship was intensely passionate and at times volatile, but always bound by love. In 2018, Heard wrote an op-ed in The Washington Post about her experience with domestic abuse. While she didn’t mention Depp by name, many believed that the post was about her ex-husband. Depp sued Heard for $50 million for defamation in 2019, claiming that the op-ed cost him acting jobs, including his roles in Walt Disney Pictures’ Pirates of the Caribbean franchise and Warner Bros. Pictures’ Fantastic Beasts series. Heard, for her part, countersued Depp for $100 million.
The trial for the case started in April 2022 and concluded in June 2022, where a seven-person jury consisting of five men and two women found Heard liable of all three counts of defamation in her lawsuit with Depp. The jury ordered Heard to pay Depp $10 million in compensatory damages and $5 million in punitive damages for a total of $15 million. Depp, for his part, was found guilty of one count of defamation against Heard by the jury and was ordered to pay her $2 million in compensatory damages and zero dollars in punitive damages for a total of $2 million. Due to the cap on punitive damages under Virginia state law, Judge Penney Azcarate reduced Heard’s punitive damages from $5 million to $350,000. No, Heard will not go to jail after she was found guilty of defaming Depp. Depp’s defamation lawsuit against Heard is a civil case, not a criminal case, which means that she won’t go to jail for her guilty verdict. “You don’t go to jail as a result of a civil finding,” attorney George Freeman of the Media Law Resource Center told Fox News in May 2022. Heard could, however, go to jail if she’s accused and convicted of perjury, the offense of willfully lying in court under oath. “The only way what happened so far in Virginia could lead to jail is if she’s accused and convicted of perjury, which there has been no official accusation of and which seems quite remote,” he said. Freeman, who specializes in cases around the First Amendment, told Fox News that he’s never seen a person charged with perjury in a civil case in his four decades in law.
Civil and criminal attorney Tim Parlatore also told Fox News that he doubts Heard will be charged with perjury. He told the publication that, in order for her to be charged with perjury, the prosecution would have to prove beyond a reasonable doubt that Heard “intentionally said something that wasn’t true and knew that it wasn’t true,” which is difficult to prove. Civil attorney Broderick Dunn—who practices law in Virginia, where Heard and Depp’s trial was held—also told Fox News about why perjury charges often aren’t pursued in abuse cases. “There are a lot of perjury cases that could be brought that aren’t to prevent a chilling effect on people with domestic violence claims,” he said, explaining that perjury charges could prevent from victims from coming forward with their allegations in fear their claims could result in prison sentences.
Parlatore also told the publication that Heard and Depp’s backgrounds as actors could also prevent law enforcement from pursuing perjury charges against Heard. “All of the normal ability to judge a witness’s demeanor and truthfulness goes out the window when you have professional actors on the stand,” he said. If Heard is convicted of perjury, however, the conviction has a maximum 10-year prison sentence under Virginia state law.
Sean Caulfield, a partner at the law firm Hodge, Jones and Allen, also told The Daily Mail in May 2022 that Heard could also be charged with perjury for her admission during the trial that she had not yet honored her pledge to donate the $7 million from her divorce settlement with Depp in 2016 to the Children’s Hospital Los Angeles and the American Civil Liberties Union, despite swearing under oath that she had, including in the United Kingdom High Court of Justice for Depp’s defamation case against The Sun in 2020. Caulfield told The Daily Mail that Heard could be charged with perjury in the U.K. because misleading a “cuts to the core of our justice system.” “Yes, I think so,” Caulfield said if it’s possible police could investigate Heard for perjury. “While it may not be a central issue to the case [the donations], perjury is the single biggest threat and cuts to the core of our justice system, so the police may be invited to investigate to show that any member of the public who lies to the court can be prosecuted for perjury.”
He continued, It is not a central issue before the court, but if Depp’s legal team are trying to paint a picture [that she is trying to keep the money], then it is. And it is always central that people do not perjure themselves. CPS guidance says you will need to know what you said was false, which can be hard, but it should not be that difficult to know whether she had made the donations or not. I can’t see a problem there. The other confusion is that she would need to be extradited. If the CPS authorises a charge, you then have to extradite her which is unlikely, especially as she is a US resident.”
Legal expert Mark Stephens, however, told The Daily Mail about how difficult it is to prosecute a perjury case. “It is notoriously difficult to bring and prosecute a perjury case. You have to show that someone deliberately told an untruth as opposed to them being confused or misremembering,” he said. “I think it would be a very difficult thing to do. Police could investigate it, but they probably would not prosecute it. The case is not about what she spent her money on, but what took place during their relationship. I accept misleading a court is a big issue, but this is a line that Depp’s team ran in London. How do you prove that she knew? She may have been given advice that the donations were made.”
He continued, “Access to bank accounts if you are a celebrity may be managed. You may well believe that you made or have committed to the donations. Nobody comes out of this case well. Depp’s legal team are just a different class. They know the evidence is there, they are not getting names wrong, misplacing things – it is a smooth, swift operation. Heard’s lawyers looks like they are being outgunned.”
Steven Heffer, Head of Privacy at the law firm Collyer Bristow, explained that a perjury conviction in the U.K. is punishable up to seven years. “Perjury is a very serious offence under English law as it strikes at the very heart of the justice system. Well known individuals including prominent politicians have found this to their cost and ended up serving prison time,” he said. “Under English law Perjury is committed in a judicial proceeding when a witness makes a statement material to that proceeding which he knows to be false or does not believe to be true – and it carries a prison sentence of up to 7 years If one of the witnesses had been proved to have lied in the course of the English libel case, they could expect a prosecution for perverting the course of justice and perjury and a likely custodial sentence.”

Mark Breyer, an Arizona-based trial and personal injury lawyer, explained in a TikTok prior to Heard and Depp’s verdict that Heard may have to file for bankruptcy if she cannot pay the damages she owes Depp. “You can’t get blood from a turnip,” Breyer said. “That’s the reality. We don’t have debtors prison anymore. So what’s going to happen is he [Depp] could go after all the money she had, she would probably file for bankruptcy, but certain things would be protected in bankruptcy. But the reality is that’s the problem with laws where people aren’t required to have insurance.”
Attorney Sandra Spurgeon of Spurgeon Law Group in Lexington, Kentucky, told CBS News after the verdict that it’s a serious deal if Heard can’t pay Depp the damages she owes him. “For an individual who doesn’t have the ability to pay the judgment and no ability to post the bond, then there is a real issue if the winning party intends to execute the judgment,” Spurgeon said. Spurgeon told CBS News that she predicts that Heard’s lawyers will try to appeal the verdict in hopes of a more favorable judgement and to reduce the payment. Another option is for Heard to post a bond for the $8.35 million in damages, which may not be feasible.
“The question is if she says, ‘Look, I don’t have it. It’s not there — you can look in my bank accounts,’ then we can talk about things like garnishing her wages,” said CBS News legal contributor Jessica Levinson told the site. “That’s not an unusual situation where somebody says, ‘I don’t have — I can’t fulfill this,’ and so I certainly think because she has earning potential, part of her wages could be garnished as a result.” CBS News explained that if Heard was to file for bankruptcy, that would only eliminate the $8 million in compensatory damages, but she’d still have to pay the $350,000 in punitive damages, which generally can’t be discharged in a bankruptcy. Spurgeon also noted that Depp could choose not to execute the judgement and waive the monetary damages which would free Heard from her financial obligations. “He’s in the driver’s seat right now,” she said.

Amber Heard can’t pay the $10.4 million she owes Johnny Depp, her lawyer revealed Thursday — as sources told The Post the actress is “broke” due to hefty legal fees associated with the bombshell defamation trial.


“Oh, no, absolutely not,” Heard’s attorney Elaine Bredehoft told NBC’s “Today” when asked if the actress had the means to cover the hefty judgment handed down by the jury on Wednesday.


The high-profile court battle with her ex-husband has left the 36-year-old actress hurting for cash, according to sources, including one who also placed the blame on Heard’s past lavish spending, on travel, clothes, gifts and wine.


Multiple sources said the “Aquaman” star had to switch legal representation and is relying on her homeowner’s insurance policy to cover the cost of her current attorneys in the case.


The bill for Heard’s attorney has mostly been footed by The Travelers Companies under terms of the actress’s insurance policy, sources said.


A vice president of the insurance firm, Pamela Johnson, was spotted in the Fairfax, Virginia, court with Heard multiple times throughout her trial. Neither Johnson nor Travelers returned calls from The Post.

Legal experts said using homeowner’s insurance policies is common in defamation cases.


“It’s a little oddity that most people don’t know. In most homeowner insurance policies, there is coverage if you are sued for defamation based on how much you pay through coverage,” Heather Heidelbaugh, a Pennsylvania trial attorney, told The Post.


While the insurance company then hires and pays for the attorney, Virginia lawyer Jeremiah Denton said most policies have a clause that stipulates that judgment costs won’t be covered.


“The insurance company will keep in its back pocket the option of denying coverage at the end of the day — denying coverage means refusing to pay the plaintiff, in this case Mr. Depp,” Denton said.

“A lot of insurance policies provide coverage for defamation but they have an exclusion in, which says ‘We will not cover any intentional wrongdoing,’ ” Denton said. “In order to win a defamation case against a public figure, you have to show intentional wrongdoing. Sometimes what it requires to get the judgment kicks you out of the policy that may pay for the judgment. That’s the dilemma.”


Representatives for Heard and Bredehoft also didn’t respond to The Post’s request for comment about the star’s financial situation.


Heard’s net worth has been estimated at between $1.5 million and $2.5 million as of Thursday, according to the Celebrity Net Worth site and other outlets — a far cry from what she owes Depp in the wake of the jury’s ruling.


Amid the lurid, six-week defamation trial, Heard and multiple witnesses had testified that the actress might not have the funds to actually pay her ex-husband.


Court testimony revealed that Heard was paid $1 million for 2018’s “Aquaman” and another $2 million for the sequel, which is due out next year. Her role in that movie has been significantly reduced.


Witnesses testified about how Heard lost several brand endorsements — including one with L’Oreal — after Depp’s lawyer launched a smear campaign against her.


Heard also never made good on her promise to donate the $7 million she received from Depp in their 2016 divorce settlement to the American Civil Liberties Union and the Children’s Hospital of Los Angeles.

She testified the donations were delayed because of her legal fees and bills.


A representative for the ACLU told jurors that the actress cut the last check for the charity in 2018 but then stopped making payments because “we learned she was having financial difficulties.”


Depp sued Heard in 2019. She testified that she had every intention of still making the donations, telling jurors: “I would love him to stop suing me so I can.”

Depp could still potentially claim the money he was awarded by garnishing his ex-wife’s wages from her two upcoming movies, levy her assets or even seize her house in California’s Yucca Valley, experts told The Post.


The three-bedroom, three-bathroom desert oasis has been valued at $1 million. Heard purchased it in 2019 for $570,000 under a private trust in the name of her accountant, according to property records seen by The Post.


“If she doesn’t have the money, then his avenue, while she’s pursuing an appeal, is to try to execute on property she owns,” or her bank accounts, Virginia appellate lawyer Steven Emmert said.


He added that if Depp wants to find out where Heard’s assets are, he could serve her with a summons for debtors interrogatories “where you summon the debtor to come to a court and his lawyer would get to ask her questions saying ‘What property do you own, what real estate do you own, what vehicles do you own, what jewelry do you own, what art collections’ — anything else that they could use to grab and sell at auction to try to pay down and pay off, ultimately, this judgment.”

Denton said that if Heard doesn’t turn over the judgment money, “[Depp] can institute collection proceedings so he can garnish [Heard’s] pay, if she has a salary or wage-type income.”


“He can attach her assets which basically means seize them. He can get to her assets, sell them and take cash,” Denton said.
