Is this civil or criminal ?

Criminal I can actually see - remember capital crimes (murder) generally have no SOL - so equating sexual assault/rape to murder as a criminal matter makes sense.

Civil - it makes ZERO sense.

Keep in mind criminal has the higher threshold of establishing guilt beyond a reasonable doubt. If the state were to charge someone 20+ years later - they are taking a HUGE burden of evidence and opening themselves up to a malicious prosecution claim if they don’t have a ton of evidence (DNA likely. - and given it’s evolving nature makes sense why the rules could be amended).

Civil - Google says 10 years - still a stretch, but better than 34.

If the law was amended in 2022 though - wouldn’t this not be applicable as the crime occurred BEFORE the change was made ?

Guessing he’s simply not paying her off out of one or both of the following:

- Not being financially secure enough to pay the asking price
- Knowing it will not be an easy case for the accuser or her attorney to make. The accuser of course likely has nothing to sue for if found to be bringing a frivolous case but her representation likely does. The potential for a case of libel seems real here making these claims after decades seems real.

They likely were angling for exactly that and got their bluff called. Now the accuser is trying to salvage something by going public with the case and trying to spin a narrative. They settle now it will of course include a non-disclosure/no comment agreement to never discuss again. The price though is likely much lower than those initial demands - she’s losing in the court of public opinion and damaging victims who will now feel the pressure to not speak out years after unfortunately.

There a huge difference unfortunately in waiting months and decades - some times you just have to forgo monetary damages and deal with shit on your own - for benefit of others. I highly suspect that is what a judge would find here ultimately.
