I have to believe the DA had to charge him with something and this was probably the only charge that had a chance of sticking (and it may not stick).

Involuntary manslaughter is defined as an unintentional killing that results either from recklessness or criminal negligence. Involuntary manslaughter is the lowest category of homicide.

They said the guns were being used off-set with live bullets and target practice during breaks on the set.

IMO the armorists is the most responsible. Baldwin's reckless behavior may be due to pointing a gun at someone, even if he thought it was not loaded. I've heard he said he didn't pull the trigger and the gun somehow went off. Not sure I believe that one but the gun can be easily checked for issues.

The first thing that comes to my mind is the term "Criminal negligence", you cannot say it's an accident or you don't know that the gun is loaded with real ammunition.

I want to know how his Atty going to defend this case.

I think they are working the recklessness side of the charge. Criminal negligence (see below), I think would be hard to prove. Saying Baldwin ignored a known or obvious risk and was criminally negligent is a stretch.

They could get hundreds of prop masters on the stand to say, "Live ammo is never on set. Everyone knows that and makes that assumption since that is industry practice." Thus, Baldwin could not have ignored an "obvious" risk.

Criminal negligence refers to conduct in which a person ignores a known or obvious risk, or disregards the life and safety of others.

why on earth would they be using props during target practice?? you would think they would have separate guns for that.....hence the term props!

i think the armorist is most responsible as well, especially it is their job to be aware of these things

i'm sure there are faulty weapons out there, but even the slightest pull on the trigger couldve set it off and he could think he didn't pull it.
