I'm not sure I understand all that but they were referring to it as a pilot mistake.

This is good new to all the pasengers.I read today that the original $30k offered to the passengers of the Delta plane that ended up up-side-down in Toronto, was not a "final offer" nor was it a goodwill gesture by the airline.
Apparently, there are laws for international flights that required Delta to make an initial offer that was not binding (no strings attached) if you take the money and it would not prohibit anyone from suing later.

SWA plan landing and had to pull up and go around to avoid a runway collision.
