Friend of mine is going to be sentenced this week because he was present in the Jan 6 rally in DC.

Did absolutely nothing wrong. Nothing.

Was turned in by a former girlfriend who held a grudge.

What a fukkin shame.

How many leftists were arrested for burning and looting Oregon for almost 80 nights in a row? How many for looting Minneapolis?

How can they literally arrest him for doing nothing? Even though he was in attendance, if he didn't do anything, I'm not understanding why they're arresting him. Is there more to the story he's just not telling you?

They said he tried to hit a cop.

The real story is a cop rushed him, he thought the cop was going to hit him, so he put his hands up to cover his face and the cop bounced off him.

Charged and will be sentenced.

You don’t get sentenced without already having been found guilty.

Not going to debate guilt/innocence - that’s evidently been done by someone if he’s being sentenced.

Post the sentence or link to the story - as curious to what he does get here. Clearly - wrong place/wrong time. There have been several who I would agree got relatively harsh sentences for their “crimes” (participation in a riot) - but these people have also been either very vocal and refused to renounce their actions or were physically in the Capitol.

Its one thing to be accused of assault on an officer in a riot in the street - it’s another to be shown in a government building after all hell broke lose. At a point no one is an “innocent” victim caught up in the mayhem. Likewise - comparative justice is not a thing - that’s child like logic. Saying someone else didn’t get caught - so I shouldn’t be punished just because I did won’t fly in the courts. You’re either guilty or innocent - that’s been decided before you were sentenced.

Anyone can (and have) been caught up in a bad situation when it all goes to shit unexpectedly. It’s what you do next that determines how the courts treat you. Hit a cop - no priors and nothing else - this should be a simple probation case if he said he wishes he hadn’t been there when it went bad. Shoot your mouth off and tell the judge how stupid they are - prepare for a 24 month stay and federal sentencing says your their 70% of the time.

There were a lot of innocent people there.

He's one of them.

He never hit anyone.

This would never have even been brought up if it wasn't for a vindictive ex girlfriend.

Some in attendance, who were invited in by Capitol police, were charged with some of the following:
Misdemeanor charges were entering and remaining in a restricted building or grounds, disorderly and disruptive conduct in a restricted building or grounds, disorderly conduct in a Capitol building, and parading, demonstrating or picketing in a Capitol building.

Others were charged with a felony charge of "obstruction of an official proceeding" but the Supreme Court ruled that the government was misapplying the obstruction statute and those charges were dismissed.

I can absolutely believe people were instructed to enter the building at a point - it’s a RIOT situation with rear pushing to the front. People of a certain age will remember The Who concert at Riverfront Stadium and what happened when the rear started pushing forward and the people at the front had no access to the inside.

Now of course there is a big difference between being “observed” in the Capitol and being seen sitting at a Senators desk posing for pictures or looting the damn place. Neither is the case here - it’s a case where someone struck an officer - again not an alleged act as once your found guilty - your guilty. Could he be wrongly found guilty - absolutely - but we have seen none of the evidence either way and it doesn’t matter anyway as the court had its say.

Again though - at best it is “wrong place/wrong time” - plenty of people have been in this situation- buddy at a bar with a big mouth - decides to take on biggest guy there (or vice versa loud mouth drunk decides to take on large buddy minding hos own business), fight breaks out and someone tries to play peacemaker and gets involved and charged. Doesn’t matter what your record is prior - only matters what an officer says/testifies to as their word is viewed as “most credible” by a court generally.

As to sentencing - federal has fairly standard guidelines that can be found on Google - look up the charge/grade and it tells you what the minimum/max is - clean record and remorse for being wrong place/wrong time (not admitting guilt - just saying should have stayed home/left when things started getting contentious) - expect minimum and federal typically is 70% of sentence before parole.

And again - the spiteful ex didn’t CAUSE him to be charged - only ratted him out/identified as the suspect. Police weren’t just pulling people off the street saying - “where were you Jan 6th” and then charging them with crimes if they were near the riot. I personally know a few who were there and split before stuff got bad.

Remember it well as they were at my moms viewing Sunday night and wanted me to ride in with them - talking about the rally. Had the funeral and no desire to drive 7 hours to DC after driving 6 back home from NC. In a way would have been interesting to say I was there at least. Can remember dad talking about being in Newark summer of ‘67 and the shit show that was being young/white and living in an apartment with 4 other Italian kids right out of HS watching the neighborhood burn - guess I missed being part of one of my generations great news events - but I’m fine with that - just like I’m good with having missed the King riots in ‘92.

She is DIRECTLY responsible for this whole mess.

She called the FBI and informed on him. They had no idea who he was and he didn't do anything wrong anyway.

Philly, Did they have video evidence of your friend being there or just the call from the GF saying he was there? They must have had video of some type.

Did your friend provide any details?
This is interesting. Its the closest I've been to someone who was involved and would love to understand the details more.

She gave him up completely.

From her info, they were able to identify him.

He never hit any officer but the government is maintaining he did.

If he is on video, to my knowledge, it was never shown in court.

The bottom line is an innocent man is going to get sentenced.

I guess if my friend decided to go to Portland Oregon or Minneapolis and decided to riot, burn, pillage, and loot with all the leftists instead of going to DC, he would be perfectly fine now.
