They say Hamilton promised them $250k each

Honestly I’m surprised this doesn’t happen more often in todays cut-throat NIL era

Sounds like the players have pretty good evidence

A lot of texts from the coach

Agreed - surprised we aren’t hearing more about these “broken promises”.

$250k isn’t that much either - compared to what many are able to secure.

The Rashada deal for example - these kids expecting millions before playing a down in college are in for rude awakening’s. The boosters will simply walk when it’s clear that the player is not meeting the overhyped expectations. What are athletes going to do - go “free agent” and try to find a better deal in the transfer portal ? What happens when those deals fail to materialize for a few?

What are they gonna do - show up on Judge Judy demanding payment ?

Coach is done this year.

There was an agreement no doubt - but good luck collecting on it. Courts likely to rule it a risk - just like someone stiffing on a bet - no doubt there was an agreement - but setting the precedent of it being “enforceable” is another matter entirely.

Coach says “I have a group of boosters who have agreed to pay you x” - players don’t get paid and sue - Coach has a defense of “they told me to tell players they would pay so I did” and booster group simply dissolves itself with no assets to pay any judgement before starting a new one next day.

It would just be like suing the friend/bartender who made the connections on an unpaid bet - the middle man won’t be held responsible- even if they were to receive a benefit from the transaction.

I would no doubt require payment up front if I was a player

I think that’s why we’re going to see these “contracts” like what Stanford is going to with Luck as GM

You know the crazy think is “contracts” is what got SMU the Death Penalty in the 80s. Players would get paid so much every week or month per their agreement when they signed

Oh the irony

Only way to do it “fairly” is establish a pay for performance fund with the NCAA. Put it out there along with the existing NIL funds - require 20% “tax” on any NIL deals to fund the player performance fund.

How many kids would opt out of a bowl if there was 50k in it for the winners ? What if you were “ineligible” for payment from the fund or NIL for 24 months following a transfer unless it was your 3rd season - think the transfer portal would be as popular ?

We all know that won’t happen though.

A “performance fund” is what Uncle Luke established for players at The U in the 80s.

Once again getting them in trouble with the NCAA at the time.

Oh the irony
